These Terms and Conditions govern the use of Provyn services. By accessing or using Provyn, you agree
to these terms.
Service Overview
Provyn provides automated communication tools designed to assist clinics in responding to missed calls, patient inquiries, appointment reminders, scheduling notifications, and other communication workflows that help clinics recover missed patient opportunities and improve operational efficiency.
Provyn does not provide medical advice, medical treatment, or clinical decision support.
Client Responsibilities
Clinics using Provyn are responsible for ensuring their communications comply with applicable healthcare regulations and patient consent requirements.
Clinics are responsible for determining what information is included in patient communications and for maintaining their own patient medical records.
Provyn functions solely as a communication platform and does not manage medical records.
HIPAA Responsibilities
Provyn supports secure communication practices designed to assist clinics in maintaining HIPAA compliance. Clinics remain responsible for their own regulatory compliance and internal privacy policies.
Business Associate Agreement
Provyn requires a Business Associate Agreement (BAA) with all clinic clients. A signed BAA is provided as part of the onboarding process and establishes the responsibilities of both parties regarding the protection of protected health information in accordance with HIPAA regulations.
Text Messaging Communications
Provyn enables clinics to communicate with patients through SMS text messaging for purposes such as responding to missed calls, following up on inquiries, appointment reminders, scheduling notifications, and other administrative communication workflows.
Clinics using Provyn are responsible for obtaining appropriate patient consent before sending SMS communications.
Message frequency may vary depending on clinic communication needs. Standard message and data rates may apply depending on the recipient’s mobile carrier.
Recipients may opt out of receiving SMS communications at any time by replying STOP. After opting out, no additional messages will be sent unless consent is provided again.
Recipients may reply HELP for additional information.
Provyn does not send marketing text messages directly to patients. Messages are sent on behalf of the clinic for administrative communication purposes.
Service Availability
Provyn aims to maintain reliable platform availability but cannot guarantee uninterrupted service.
Temporary interruptions may occur due to maintenance, updates, or third party infrastructure.
Payment and Subscription
Provyn services may be provided through subscription agreements. Billing terms, onboarding terms, and pricing are outlined within the client service agreement.
Termination
Either party may terminate services according to the terms outlined in the applicable service agreement.
Limitation of Liability
Provyn provides software tools intended to assist clinics with communication and scheduling workflows.
Provyn does not control how clinics use the platform or the content of communications sent through the system.
Provyn is not responsible for clinical decisions, patient outcomes, or scheduling decisions made by a clinic.
To the fullest extent permitted by law, Provyn shall not be liable for indirect, incidental, or consequential damages arising from the use of the platform.
Updates to Terms
Provyn may update these Terms periodically. Continued use of the platform indicates acceptance of the updated Terms.
